U.S. Supreme Court Affirms Rights of Student Athletes to Market Name and Likeness

In a case called “NCAA v. Alston, et. al.,” the U.S. Supreme Court decided that student athletes may sell their name and image / likeness.

Nineteen states responded overnight by passing legislation regarding compensation for student athletes.

Kentucky’s Executive Order permitting athletes to sell their name and likeness will become effective on July 1, 2021, along with laws passed already in Alabama, Florida, Georgia, Mississippi, New Mexico and Texas.

The NCAA has approved changes to eligibility rules to allow compensation of student athletes in response to the decision of the U.S. Supreme Court, after fighting it tooth and nail. The NCAA clearly never represented the interests of student athletes.

U.S. Congress has held hearings on creating a national standard for compensation.

Without the Governor’s Executive Order, Kentucky colleges and universities would face a competitive disadvantage as other states’ laws go into effect on July 1, 2021.

Kentucky colleges and universities must now provide education and other resources to help students with the following:

– financial literacy,
– time management,
– social media management,
– brand management.

However, schools have the right to “reasonably limit the time, dates and associations from which the student-athlete may earn compensation.”
